This Consumer Health Data Privacy Policy (this “Policy”) supplements Intra-Cellular Therapies Inc.’s (“Intra-Cellular Therapies,” “we,” “us,” or “our”) Privacy Statement at https://www.intracellulartherapies.com/privacy-policy/ and applies to the collection of consumer health data that is protected under the Washington My Health My Data Act and the Nevada Consumer Health Data Privacy Law (collectively, “US State Consumer Health Data Privacy Laws”) collected through our operations, provision of products, and websites (the “Services”). This Policy does not apply to information or practices that are not subject to the US State Consumer Health Data Privacy Laws, such as publicly available information or job applicant and employee information. The terms in this Policy have the same meaning as under the applicable US State Consumer Health Data Privacy Laws.
We may change this Policy at any time. If we make changes, we will post the latest version on our websites.
1. The Categories of Consumer Health Data We Collect
The data we collect depends on the context of your interactions with Intra-Cellular Therapies. We may collect the following categories of “consumer health data,” which means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status, subject to certain exceptions:
- Individual health conditions, treatment, diseases, or diagnosis;
- Social, psychological, behavioral, and medical interventions;
- Bodily functions, vital signs, symptoms, or measurements of the information described in this Section 1;
- Use or purchase of prescribed medication;
- Diagnoses or diagnostic testing, treatment, or medication;
- Health-related surgeries or procedures;
- Gender-affirming care information;
- Reproductive or sexual health information;
- Biometric data;
- Genetic data;
- Precise location information that could reasonably indicate a consumer’s attempt to acquire or receive health services or supplies;
- Data that identifies a consumer seeking healthcare services;
- Information processed to associate or identify a consumer with the data described above that is derived or extrapolated from non-health information.
2. Purposes of Collection and How Intra-Cellular Therapies Uses Consumer Health Data
Generally, we may collect and use the consumer health data for the purposes set forth below:
- Providing Services and support. To communicate with you about your use of our Services; to provide our Services; to respond to your inquiries; for customer service purposes; for patient assistance programs, co-pay programs, vouchers, and other patient support programs.
- Analytics and improvement. To better understand how users access and use our Services, products, and offerings, and for other research and analytical purposes, such as to evaluate and improve our Services and business operations; to develop and improve our Services and features; for internal quality control and training purposes.
- Customization and personalization. To tailor the content that we may send you and that we may display on our websites, including to offer personalized help and instructions, and to otherwise personalize your experience.
- Marketing and advertising. For example, to send you information about our Services, such as newsletters, and other marketing content, including about third party products and services we think may interest you, as well as any other information that you sign up to receive.
- Security and protection of rights. To protect our rights and our business operations; to prevent and detect fraud, unauthorized activities and access, and other misuse; to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our privacy policies or statements.
- Legal proceedings and obligations. To comply with the law and our legal obligations; to respond to legal process and related legal proceedings.
- General business and operational support. To consider and implement mergers, acquisitions, reorganizations, financings, bankruptcies, and other business transactions; for activities related to the administration of our general business, such as accounting, auditing, compliance, recordkeeping, and legal functions.
3. The Categories of Sources From Which We Collect Consumer Health Data
In general, we may collect consumer health data from the following categories of sources:
- Directly from you;
- Those authorized to provide personal information on your behalf, such as your guardian, healthcare provider, or authorized representative;
- Our vendors and other agents that collect consumer health data on our behalf;
- Our business partners;
- Your devices;
- Publicly available sources;
- Third party sources such as governmental sources, payment processors, healthcare providers, or other third parties.
4. The Categories of Consumer Health Data That We Share
We may share the following categories of consumer health data with third parties and affiliates:
- Individual health conditions, treatment, diseases, or diagnosis;
- Social, psychological, behavioral, and medical interventions;
- Bodily functions, vital signs, symptoms, or measurements of the information described in this Section 4;
- Use or purchase of prescribed medication;
- Diagnoses or diagnostic testing, treatment, or medication;
- Health-related surgeries or procedures;
- Gender-affirming care information;
- Reproductive or sexual health information;
- Biometric data;
- Genetic data;
- Precise location information that could reasonably indicate a consumer’s attempt to acquire or receive health services or supplies;
- Data that identifies a consumer seeking healthcare services;
- Information processed to associate or identify a consumer with the data described above that is derived or extrapolated from non-health information.
5. The Categories of Third Parties and Specific Affiliates with Whom We Share Consumer Health Data
Intra-Cellular Therapies may share the categories of consumer health data included in Section 4 with the following categories of third parties and specific affiliates:
- Business partners;
- Governmental entities;
- Regulators;
- Vendors and other processors that assist us with business operations such as analyzing website usage, information technology, information security, drug safety, patient assistance programs, and other patient support;
- Operating systems and platforms;
- Parties to litigation and others as required by law;
- Third parties we, our affiliates, or subsidiaries are or may be acquired by, merged with, financed by, or invested in by another company, or if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected about you to the other company. We may also share certain personal information as necessary prior to the completion of such a transaction or corporate transactions such as financings or restructurings, to lenders, auditors, and other advisors, including attorneys and consultants, as part of due diligence or as necessary to plan for a transaction.
6. Your Privacy Rights
You have the following rights under the applicable US State Consumer Health Data Privacy Laws, subject to applicable exceptions:
- Know/Access: The right to confirm whether we collect, share, or sell your consumer health data and the right to access such consumer health data;
- Withdraw consent: The right to withdraw consent from our collection and sharing of your consumer health data; and
- Deletion: The right to have your consumer health data deleted.
Exercising Your Privacy Rights

Before completing your request, we may need to verify your identity or your authority to make a request on behalf of another person. We may request additional documentation or information solely for the purpose of verifying your identity, depending on the type of your request.
If we deny your request to exercise a right, you can appeal our decision by using the Consumer Request Form. If your appeal is unsuccessful, you can file a complaint with:
